These Terms of Service ("Terms") govern your use of https://alderon-us.com (the "Site") and any purchase you make from Alderon ("we," "us," "our"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy, and our Refund and Returns Policy, which are incorporated by reference. Please read them carefully. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to make a purchase. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate and complete.

2. Products, Descriptions, and Availability

We make every effort to describe and display our products accurately. Colors may appear differently depending on your screen, and minor variations in materials and finishes are natural. Measurements and size guides are provided as a guide only. Products are subject to availability; if an item you ordered becomes unavailable, we will let you know and refund any amount charged for it.

3. Prices, Taxes, and Payment

All prices are in U.S. dollars (USD). Shipping charges and applicable sales tax are calculated and shown at checkout before you complete your order. We may change prices at any time, but changes will not affect orders already accepted.

Despite our best efforts, a product may occasionally be listed at an incorrect price. If the correct price is higher than the price shown, we will contact you before shipping to confirm whether you wish to proceed; if we cannot reach you, or you do not wish to proceed, we will cancel the order and refund any amount charged.

Payment is taken when you place your order. We accept the payment methods shown at checkout, including Shopify Payments (including Shop Pay, Apple Pay, and Google Pay) and any other payment provider you select. By providing a payment method, you confirm that you are authorized to use it.

4. Orders and Acceptance

Placing an order is an offer to buy. The order confirmation email acknowledges that we have received your order; our acceptance takes place when we ship the products to you. We may refuse or cancel an order before shipping for reasons including product unavailability, a pricing or description error, suspected fraud, or a violation of these Terms. If we cancel an order after payment, we will refund the full amount charged.

5. Shipping and Risk of Loss

Shipping options, delivery estimates, and delivery problems are covered by our Shipping Policy. Title to and risk of loss of the products pass to you upon delivery to the shipping address you provided.

6. Returns and Refunds

Returns, refunds, and damaged or incorrect items are covered by our Refund and Returns Policy, which forms part of these Terms.

7. Promotions and Discount Codes

Promotions and discount codes are subject to the conditions stated when they are offered, including any expiration date and eligible products. Unless stated otherwise, only one discount code can be used per order, and codes cannot be applied to orders already placed. We may modify or end a promotion at any time without affecting orders already accepted.

8. Accounts

You may create an account to track orders and speed up checkout. You are responsible for keeping your login details confidential and for all activity under your account. Please tell us immediately if you believe your account has been accessed without your permission.

9. Intellectual Property

The Site and all of its content — including the Alderon name and logo, text, product descriptions, photographs, graphics, and design — are owned by or licensed to Alderon and are protected by copyright, trademark, and other intellectual property laws. You may use the Site for your personal, non-commercial shopping. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission.

10. Acceptable Use

You agree not to use the Site to: violate any law or regulation; infringe the rights of others; submit false or misleading information; transmit viruses or malicious code; scrape, harvest, or collect data from the Site by automated means; interfere with the security or operation of the Site; or resell products purchased from us in a way that misrepresents your relationship with Alderon. We may suspend or terminate your access to the Site if you breach these Terms.

11. Reviews and Other Content You Submit

If you submit reviews, comments, photos, or other content to us or to the Site, you grant Alderon a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business, including in marketing. You confirm that your content is your own, is accurate, and does not infringe the rights of others. We may remove any content at our discretion.

12. Third-Party Links

The Site may contain links to third-party websites and services. We do not control them and are not responsible for their content, products, or practices. Your use of them is at your own risk and subject to their terms.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Site is provided "as is" and "as available," and we disclaim all warranties regarding the Site, express or implied, including any warranty that the Site will be uninterrupted, error-free, or free of harmful components. Our products are covered by the rights described in our Refund and Returns Policy and by any warranty that applies under the laws of your state and cannot be excluded.

14. Limitation of Liability

To the fullest extent permitted by law, Alderon will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising out of or related to your use of the Site or the purchase of our products, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of or related to an order is limited to the amount you paid for that order.

Some states do not allow the exclusion or limitation of certain warranties or damages. In those states, the limitations above apply only to the extent permitted by law, and nothing in these Terms limits any consumer right that cannot be waived.

15. Indemnification

You agree to indemnify and hold harmless Alderon and its owners, employees, and agents from any claim, loss, or expense, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

16. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to them or to your purchase are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-law principles, except where the consumer protection laws of your state of residence provide rights that cannot be waived.

Most concerns can be resolved quickly by contacting us at support@alderon-us.com. Before starting any legal proceeding, you agree to send us a written description of the issue and to allow 30 days for us to try to resolve it with you informally. If we cannot resolve it, any legal proceeding must be brought in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts, except that you may bring an individual claim in the small claims court of the county where you live.

17. Notice to California Residents

Under California Civil Code Section 1789.3, California residents are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

18. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top shows when they were last revised. Changes apply to orders placed after they are posted; the Terms in effect when you placed your order continue to apply to that order.

19. General

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. These Terms, together with the policies referenced above, are the entire agreement between you and Alderon regarding the Site and your purchases. You may not assign your rights under these Terms without our consent.
